SUNSIGNS.ORG allows you to access its website and app and all the content in them on certain terms and conditions specified below. By accessing or subscribing to any part of this website or app, you are explicitly agreeing to the terms and conditions below. These terms and conditions were updated as on 28 February 2019, and SUNSIGNS.ORG reserves all rights to change, modify or alter these terms and conditions at any point of time with or without notifying existing users and subscribers. If you do not agree to any new terms and conditions, you should not use this app or website.

These license terms are an agreement between SUNSIGNS.ORG and you (user). They apply to the app that accompanies these license terms. The conditions also apply to any SUNSIGNS.ORG website, updates, Internet-based services and support services for this app, unless other terms accompany those items. If so, those terms apply.

The references in these terms and conditions to “SUNSIGNS.ORG” (or “we,” “us” or “our”) refer to (SUNSIGNS.ORG) or any associate/subsidiary concern that may be operating the app and its associated sites.

Mandatory Registration

Registration associates the use of the app with a specific device. During registration, the app will send information about the app and the device to SUNSIGNS.ORG. This information includes the version, the license version, language, product id of the app and information derived from the hardware configuration. By using the app, you consent to the transmission of this information. You can register the app using the internet or via phone; internet service charges may apply while registering using the internet.

Updation

The app will from time to time update or require download of the latest features of the app as well as notifications of the latest product offers. During this process, the app will send information about the app to SUNSIGNS.ORG. This information includes the version of the app, product key, Language, Product ID, and other SUNSIGNS.ORG app information. By using the app, you consent to the transmission of this information.

1. Access to SUNSIGNS.ORG and related apps

All content – textual, still pictures, graphs, voice or video – made available on SUNSIGNS.ORG apps (including content available on our websites, email newsletters) (from now on referred to as the “content”) belongs to SUNSIGNS.ORG or its content partners or licensors. SUNSIGNS.ORG or its partners/licensors own all intellectual property rights (including copyright and database rights) in the content. You may retrieve and view content on a computer screen, PDA or mobile, print individual pages on paper (but not photocopy them) and store such pages in electronic form on disk or on your mobile (but not on any server or other storage device connected to a network) for your personal, non-commercial use.

You may not use the app for any unlawful purpose. Except as indicated above, you may not reproduce, publish, broadcast, transmit, modify, adapt, create derivative works of, store, archive or in any way commercially exploit any of the content. Without limitation, you may not do any of the following without prior written permission from SUNSIGNS.ORG (and neither may you allow a third party to do any of the same)

You may not rRedistribute or resale any of the content, including our headlines, create a database in electronic or structured manual form by systematically downloading and storing all or any of the content or deep link to, frame, spider, harvest or scrape the content or otherwise access the content for similar purposes or use any machine, electronic, web-based or similar device to read or extract the content by automated techniques, reverse engineer, decompile or disassemble the app; use the app in any way that is against the law; rent, lease, copy, distribute, sell or lend the app.

2. Resale, reprint and republication rights

Requests to republish or redistribute content should be addressed to SUNSIGNS.ORG’s syndication service team at https://www.sunsigns.org/contact-us/ . Not for resale app. You may not sell this app.

3. Privacy Policy

All information received by you from your use of the SUNSIGNS.ORG apps will be used by SUNSIGNS.ORG by our Privacy Policy. The privacy policy is outlined separately here https://www.sunsigns.org/privacy-policy/ .

4. Warranties and Limitation of Liability

The SUNSIGNS.ORG’s content is for your general information and use and is not intended to address your particular business or other requirements. In particular, the content does not constitute any form of advice, recommendation, representation, endorsement or arrangement by SUNSIGNS.ORG and is not intended to be relied upon by users in making (or refraining from making) any specific investment or other decisions. Appropriate independent advice should be obtained before making any such decisions. Any agreements, transactions or other arrangements made between you and any third party named on (or linked to from) the SUNSIGNS.ORG apps are at your sole risk and responsibility. Any information that you receive via the SUNSIGNS.ORG apps whether or not it is classified as “real time,” may have ceased to be current by the time it reaches you. SUNSIGNS.ORG is not responsible for any use of the content by you outside its scope as stated in these terms and conditions.

SunSigns.Org. is not an accredited program or institution. Information on this app or related content or service is provided for entertainment purposes only and is not experimentally proven. In no way should content on this app or similar content or service be considered as conforming with any standards or qualifications prescribed by any entity or organization.

Any data, interpretation, prediction or information in any form received through SunSigns.Org should not be treated as a substitute for advice or treatment you would typically receive from medical professionals, financial advisors, legal consultants, and other such licensed services. Comparisons between the calculations made by SUNSIGNS.ORG and those published in almanacs are unwarranted. SunSigns.Org shall not entertain any dispute on differences arising out of such comparisons.

SUNSIGNS.ORG DISCLAIMS ANY WARRANTIES IN RESPECT OF THE SUNSIGNS.ORG APPS. TO THE EXTENT ALLOWED BY APPLICABLE LAW, SUNSIGNS.ORG HEREBY DISCLAIMS ALL OTHER WARRANTIES, CONDITIONS OR DUTIES OF EVERY NATURE WHATSOEVER (EXCEPT ANY DUTIES OF GOOD FAITH), INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF SATISFACTORY QUALITY, MERCHANTABILITY OR OF FITNESS FOR A PARTICULAR PURPOSE, ANY EXPRESS OR STATUTORY WARRANTIES, AND ANY WARRANTIES OR DUTIES REGARDING ACCURACY, TIMELINESS, COMPLETENESS, PERFORMANCE, AVAILABILITY, LACK OF NEGLIGENCE OR OF WORKMANLIKE EFFORT.

OUR LIABILITY EXCLUSION

TO THE FULL EXTENT ALLOWED BY APPLICABLE LAW, YOU AGREE THAT SUNSIGNS.ORG WILL NOT BE LIABLE TO YOU FOR ANY LOSSES WHICH RELATE TO YOUR BUSINESS OR INVESTMENT CHOICES OR WHICH ARE NOT A DIRECT CONSEQUENCE OF YOUR USE OF THE SUNSIGNS.ORG APPS (INCLUDING LOST PROFITS OR LOSS OF PRIVACY OR LOSS OF OR DAMAGE TO DATA) OR WHICH ARISE AS A RESULT OF YOU USING THE SUNSIGNS.ORG APPS OUTSIDE THE SCOPE OF THESE TERMS AND CONDITIONS. IN ADDITION TO BUT SEPARATE FROM THE ABOVE SPECIFIC EXCLUSION AND TO THE FULL EXTENT ALLOWED BY APPLICABLE LAW, YOU ALSO AGREE THAT SUNSIGNS.ORG WILL NOT BE LIABLE TO YOU FOR ANY OTHER INDIRECT, SPECIAL, CONSEQUENTIAL INCIDENTAL, PUNITIVE OR EXEMPLARY DAMAGES WHATSOEVER THAT ARISE OUT OF OR ARE RELATED TO YOUR USE OF THE SUNSIGNS.ORG WEBSITE AND APPS.

YOUR REMEDIES

SUNSIGNS.ORG SHALL USE REASONABLE ENDEAVOURS TO PROMPTLY REMEDY ANY FAULTS IN THE SUNSIGNS.ORG APPS OF WHICH IT IS AWARE. YOU AGREE THAT YOUR ONLY OTHER REMEDY (INCLUDING FOR NEGLIGENCE) FOR ANY DAMAGES THAT YOU INCUR ARISING OUT OF YOUR USE OF THE SUNSIGNS.ORG APPS (TO THE EXTENT THAT SUNSIGNS.ORG’s LIABILITY IS NOT EXCLUDED BY THIS SECTION) IS AS FOLLOWS:

Without limiting the above, SUNSIGNS.ORG is not liable for matters beyond its reasonable control. SUNSIGNS.ORG does not control telephones, third party communications networks (including your Internet Service Provider) or the Internet or the acts of third parties.

SUNSIGNS.ORG also disclaims any or all warranties or fitness for a particular purpose, or merchantability or against infringement. In no event will SunSigns.Org., its employees, agents, or contractors, be liable to you for any damages or losses, including without limitation indirect, consequential, special, incidental or punitive damages resulting from or caused by SunSigns.Org., even if its contents advise of the possibilities of such damages.

The app versions and the predictive text in the reports are subject to continuous modifications, including the addition of new chapters. This is necessitated by the nature of the content and our constantly evolving research findings. SUNSIGNS.ORG cannot be held responsible for the decisions that may be taken by anyone based on the reports generated using the app.

Under no circumstances shall SUNSIGNS.ORG or any related firm or person be liable for any loss, damage or injury (including without limitation any loss of profit, indirect, consequential or incidental loss, damage or injury) arising from the supply or use of the app and any accompanying hardware. Also, in no event does SUNSIGNS.ORG authorize you to use SunSigns.Org app in applications or systems where SunSigns.Org app’s failure to perform can reasonably be expected to result in a physical injury, or material damage or loss of life. Any such use by you is entirely at your own risk, and you agree to hold SunSigns.Org harmless from any claims or losses relating to such unauthorized use.

5) Third party sites and services

The SUNSIGNS.ORG apps may contain links to other Internet websites or online and mobile services provided by independent third parties (“Third party sites”), either directly or through frames.

Third party sites may be co-branded with SUNSIGNS.ORG, and so include SUNSIGNS.ORG’s trademark. SUNSIGNS.ORG is not responsible for the availability or content of Third-party sites and will not be a party to, or in any way responsible for, any transaction concerning goods or services available from such Third-party sites. If you purchase products or services from a Third-party site, your contract for such products or services will be with the third party and not with SUNSIGNS.ORG. Our privacy policy does not apply to Third party sites.

SUNSIGNS.ORG apps contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the SUNSIGNS.ORG apps comply with international and national laws. SUNSIGNS.ORG will not be liable for any error or inaccuracy in advertising or sponsorship material.

6) Choice of Law and Jurisdiction

These terms and conditions shall be governed by and construed by the laws of the Government of India. Users of SUNSIGNS.ORG apps also explicitly agree that only courts in India shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these terms and conditions, and for those purposes irrevocably submit all disputes to the jurisdiction of Indian courts.

7) General

You may not assign, sub-license or otherwise transfer any of your rights under these terms and conditions. If any provision of these terms and conditions is found to be invalid by any Indian court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect.

Failure by either party to exercise any right or remedy under these terms and conditions does not constitute a waiver of that right or remedy. Headings in these terms and conditions are for convenience only and will have no legal meaning or effect.

Your license to use the app under this agreement shall continue until it is terminated by either party. You may terminate this agreement at any time, by discontinuing use of all or any of the app and by destroying all copies of the app in your possession and control. This agreement and the license granted to you under this agreement terminate automatically if you breach any term of this agreement.
